Copyright Policy

Unauthorized duplication, distribution, and use of copyrighted material outside the boundaries of fair use is illegal and can expose the violator to severe civil and criminal liability under Federal statutes. This applies to all types of copyrighted works, including music, movies, software, and other literary and artistic works. No member of the College community is permitted to store, transmit, or make available unauthorized copies of copyrighted material using computers, networks, storage media, or peer-to-peer file transfer services that promote or lead to copyright infringement. Not only are these activities illegal, but they can also increase security risks for computer systems by introducing computer viruses, Trojan horses, spyware, and by exposing private files on your computer and those of your colleagues.

The Recording Industry Association of America (RIAA) has been monitoring colleges and universities throughout the country in an effort to identify and seek reparation from individuals engaged in unlawful copyright activities. In addition to damaging the reputation of the institution, such activities may result in financial penalties.

Employees engaging in unauthorized activities on a College computer will be subject to disciplinary action, which may include termination. In addition, the College will cooperate in any resulting legal proceedings. Anyone who has knowledge of unauthorized copies of music, movies, software, or other copyrighted works stored on College computers should delete them immediately.

While copyright holders have exclusive rights over their works, the Fair Use provision of U.S. Copyright Law provides flexibility for certain activities related to teaching, scholarship, and research. Members of the John Jay College community are encouraged to use the CUNY Intellectual Property and Copyright Resource Page to help make informed decisions regarding the use of copyrighted materials.
